I. GENERAL PROVISIONS

  1. These Terms of Use set out the rules for the use of the service.globalcdt.com platform hosted on the www.globalcdt.com website owned and administered by Corporate Diplomats & Translators Sp. z o.o. with its registered office at ul. Ksawerów 3, 02-656 Warszawa, entered by the District Court for the Capital City of Warszawa, 13th Business Division of the National Court Register under No. 0000863770, NIP [VAT] No. 1182214829, REGON [National Official Business Register] No. 387299795, e-mail address: office@globalcdt.com.
  2. The service.globalcdt.com platform owned by Corporate Diplomats & Translators Sp. z o.o. is used by Corporate Diplomats & Translators Sp. z o.o. to provide Services to the Users of the service.globalcdt.com, platform, i.e. to sell services to the extent and under the conditions set forth in these Terms of Use.
  3. These Terms of Use are addressed to the Users of www.globalcdt.com. The provisions of these Terms of Use shall apply to both consumers and entrepreneurs within the meaning of the Polish Civil Code of 23 April 1964 (consolidated text, Dz.U. [Journal of Laws] of 1964, No. 16, item 93, as amended) unless the Terms of Use explicitly state otherwise.
  4. Corporate Diplomats & Translators Sp. z o.o. makes these Terms of Use available free of charge to the Users of the service.globalcdt.com platform at www.globalcdt.com prior to entering into a service contract and in a manner as to enable them to obtain, reproduce, and record the content of these Terms of Use.

II. DEFINITIONS

Corporate Diplomats & Translators – as defined in these Terms of Use: Corporate Diplomats & Translators Sp. z o.o. with its registered office at ul. Ksawerów 3, 02-656 Warszawa, entered by the District Court for the Capital City of Warszawa, 13th Business Division of the National Court Register under No. 0000863770, NIP [VAT] No. 1182214829, REGON [National Official Business Register] No. 387299795, e-mail address: office@globalcdt.com.

Business Day – any day from Monday to Friday, from 8 a.m. to 5 p.m., excluding public holidays.

Registration Form – an interactive form available at www.globalcdt.com in the “Register” tab used to create an individual Account.

Client – a natural person with full legal capacity to act or a legal person or other unincorporated organisational unit, acting through an authorised person who has entered, or intends to enter, into a service contract with Corporate Diplomats & Translators Sp. z o.o. under the rules set forth in these Terms of Use.

Account – an electronic service marked with individual access data (password and login) assigned to the User by Corporate Diplomats & Translators Sp. z o.o.; the Account constitutes a set of Client data, in particular information about the Client’s enquiries and contracts entered into with Corporate Diplomats & Translators Sp. z o.o.

service.globalcdt.com – a dedicated web-based platform hosted on www.globalcdt.com.

Terms of Use – these terms of use of the service.globalcdt.com platform.

Offer Specification – a quote of the Service with precise conditions for its performance, specifying in particular the price of the Service determined on the basis of a specification submitted by the Client and materials/files supplied/uploaded by the Client, with the contents to be translated or otherwise processed and the Client’s individual expectations, such as form, type, manner of delivery, and Service completion date.

Service – a service provided by Corporate Diplomats & Translators Sp. z o.o. in accordance with the provisions of these Terms of Use.

User – a natural person with full legal capacity to act or a legal person or other unincorporated organisational unit, acting through an authorised person who uses or intends to use service.globalcdt.com.

 

III. SERVICE.GLOBALCDT.COM RULES OF USE

  1. Corporate Diplomats & Translators shall provide the following electronic services to the User via www.globalcdt.com:
    1. browsing the contents;
    2. registering the Account on the service.globalcdt.com platform;
    3. generating a quote for the translation.
  2. Corporate Diplomats & Translators agrees to use the service.globalcdt.com platform to provide the services referred to in item 1 above to the extent and under the conditions set forth in these Terms of Use.
  3. Each visitor to www.globalcdt.com can browse and read its contents free of charge.
  4. Only the Users who have completed the registration process can use the Account. To register the Account, the User shall complete the Registration Form available on www.glbalcdt.com in the “Register” tab and approve the data entered by clicking on the “Register” button. In order to confirm the registration, the User shall activate the link provided in an e-mail automatically sent to the e-mail address provided by the User in the Registration Form.
  5. The User shall provide the following data in the Registration Form:
    1. If the User is a natural person (“private person” in the form): name and surname, place of residence, e-mail address, contact phone number, and password;
    2. If the User is a legal person or an unincorporated organisational unit (“company” in the form): name (of the company), address of its registered office, NIP [VAT] No., KRS [National Court Register] No., e-mail address, mobile phone number, password, and name and surname of the contact person.
  6. The User’s Account shall be registered after the User has read the provisions of these Terms of Use and the Declaration on the Provision of Personal Data, and accepted them by ticking the “I accept” checkbox, i.e. making a statement of intent, in the User’s registration process. Upon registration of the Account, the User may opt in to receive information about new products, services, and specials offered by Corporate Diplomats & Translators.
  7. Following the registration, Corporate Diplomats & Translators shall send the User access data (unique password and login). The User shall keep confidential its access data received from Corporate Diplomats & Translators and shall not to disclose them to third parties.
  8. The registered User shall, in particular, have the right to:
    1. a) place an order for a service, e.g. a translation, an expert opinion, an e-book, etc., and download the text of the service provided;
    2. negotiate the terms of order execution;
    3. temporarily store the documents relating to the service provided, and own materials;
    4. express an opinion on the services provided by Corporate Diplomats & Translators;
    5. keep detailed statistics on its activities on the service.globalcdt.com platform;
    6. view the summary of billing information and payments for the services provided.
  9. The “User Account” service shall be provided free of charge for an indefinite period. The User can delete the Account at any time without giving any reason by cancelling the Account. The Account cancellation shall take effect after the User has submitted the relevant request to Corporate Diplomats & Translators: by e-mail to office@globalcdt.com or by letter to Corporate Diplomats & Translators Sp. z o.o., with its registered office at ul. Ksawerów 3, 02-656 Warszawa.
  10. The information about the Users, made available on the service.globalcdt.com platform, may be provided by Corporate Diplomats & Translators to competent bodies and public authorities only in the cases stipulated in the law.
  11. “What can we do for you?” is a one-time electronic service which is terminated once Corporate Diplomats & Translators generates a specification/offer in accordance with the information submitted by the User. The use of the “What can we do for you?” service shall not require the Account registration by the User. In order for Corporate Diplomats & Translators to provide a quote under the “What can we do for you?” service, the User shall provide its name and surname/company name, e-mail address, subject of the order and additional information (optional). Corporate Diplomats & Translators shall generate a preliminary quote within 1 (one) Business Day (typically 5 to 30 minutes). The information in the offer generated under the “What can we do for you” service shall not be legally binding and shall not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code of 23 April 1964. (Dz.U. No. 16, item 93, as amended).
  12. Each recipient of the electronic services provided by Corporate Diplomats & Translators in the service.globalcdt.com platform shall use it in compliance with the applicable law and good practices, respecting personal rights of third parties. All data entered shall be accurate and complete. The recipient of the electronic services referred to in item 1 above shall not disseminate any unlawful, racist and vulgar content.

IV. CONDITIONS FOR ORDER PLACEMENT AND EXECUTION

1. Enquiry and Order Placement

  1. In order to place an order, i.e. to make a statement of intent and directly enter into the contract with Corporate Diplomats & Translators for the performance of the Service, the Client shall submit the enquiry.
  2. The enquiry can be submitted on the individual User Account in oneQ of the following ways: filling in the form available after logging in to the Account, using the INQUIRIES tab, clicking on the „Add an enquiry” checkbox, or generating an enquiry and sending it by e-mail to office@globalcdt.com. The enquiry shall instruct Corporate Diplomats & Translators to prepare the Offer Specification. Corporate Diplomats & Translators shall generate the Offer Specification free of charge.
  3. If the enquiry has been submitted on the individual Account, Corporate Diplomats & Translators shall immediately, within 1 (one) Business Day (typically 5 to 30 minutes), prepare the Offer based on the specification, post it to the Account in the OFFERS tab for acceptance by the Client and send a notification to the e-mail address provided during registration, specifying that the Offer for the service has been generated. The Client may accept the Offer within 2 (two) calendar days from the date it is posted to the Account. To accept the Offer, the Client shall log in to the service.globalcdt.com platform and approve the quote by clicking the „Accept the offer” checkbox.
  4. If the enquiry has been submitted by e-mail, Corporate Diplomats & Translators shall immediately, within 1 (one) Business Day, prepare the Quote/Offer and, based on the specification for translation, send the Offer, along with these Terms of Use and the Declaration on the Provision of Personal Data in PDF format, to the provided e-mail address for acceptance. The Client may accept the quote within 2 (two) calendar days from the day of its receipt. To accept the Offer, the Client shall send by e-mail the statement confirming that they accept the quote for the translation, and have read and accept these Terms of Use, as well as the Declaration on the Provision of Personal Data.
  5. If the Client fails to accept the Offer generated by Corporate Diplomats & Translators by the date specified in items 3 and 4 above, the Offer shall be automatically cancelled.
  6. The net value indicated in the Offer and the applicable VAT shall constitute the price for the Service. In the case of translations and related services, the price shall depend on the following factors: number of graphic and typographic characters or words, level of specialisation, language pair, DTP, deadline, sworn certification of the document, etc. In the case of other services, price offers shall be set individually depending on the amount of time needed. 
  7. The contract between the Client and Corporate Diplomats & Translators for the performance of the Service shall be deemed entered into provided the Client has accepted the Offer or Corporate Diplomats & Translators has received the statement of acceptance of the Offer by e-mail, i.e. the order has actually been placed. 
  8. To place the order, the Customer shall read and accept the Terms of Use, and give its consent to the use and processing of its personal data for the purpose of executing the order. 
  9. The Client shall be informed of the total price of the Service, delivery costs and other costs (and, if their amount cannot be determined, of the obligation to pay them) at the time the order is placed at the latest. 
  10. The order for the provision of the service shall be deemed to be received and accepted for execution if the order status in the Client individual Account has been changed to “In progress”, or Corporate Diplomats & Translators has sent the Client the relevant message to the e-mail address indicated by the Client, confirming that the order has been accepted for execution. 
  11. Making these Terms of Use available at www.globalcdt.com and sending the Client a message referred to in item 4 above by e-mail shall be tantamount to recording and securing the content of the contract for the performance of the Service, and making it available to the Client. 

2. Order execution

  1. Corporate Diplomats & Translators shall provide the service as free from defects within the meaning of Articles 556 and 5561–5563 of the Polish Civil Code of 23 April 1964 (consolidated text, Dz.U. of 1964 No. 16, item 93, as amended). 
  2. Corporate Diplomats & Translators shall commence performance of the Service after the Customer has placed the order and, if the Customer has chosen to pay in advance, after the payment has been credited to the bank account of Corporate Diplomats & Translators. 
  3. Corporate Diplomats & Translators represents that it shall cooperate with a number of translators (subcontractors), coaches, experts, and consultants. This means that any order placed by the Client may be executed by a third party (subcontractor) with whom Corporate Diplomats & Translators has the relevant contract with the appropriate quality, confidentiality, and data protection clauses. 
  4. Orders, especially orders for translations and written content, shall be processed electronically by e-mail and the service.globalcdt.com platform or in a paper form by post (Poczta Polska S.A.) or courier service to the address specified by the Client. The translation delivery method shall be decided by the Client at the time the enquiry for the Service is submitted
  5. The delivery of the completed translation by electronic means and personal collection by the Client shall be free of charge. Should the delivery of the completed translation involve additional costs (e.g. courier services), these shall be covered by the Client. The total cost of delivery of the translation shall be communicated to the Client at the moment the Client places the order, and in particular the moment at the moment the Client makes a statement on intent to enter into the contract with Corporate Diplomats & Translators. 
  6. The order completion date shall depend, inter alia, on the following factors: number of characters or words, level of specialisation, language pair, DTP, required availability of coaches, level and scope of consultancy services, etc. 
  7. For the Service covering 1 (one) translation page, the delivery time shall be: (1) for electronic delivery – up to 2 (two) Business Days; (2) for delivery by postal operators – up to 7 (seven) Business Days for domestic shipments and up to 14 (fourteen) Business Days for foreign shipments. For other services, delivery times shall be agreed individually with the Client. 
  8. For Clients that are not consumers within the meaning of Article 221 of the Polish Civil Code of 23 April 1964 (consolidated text, Dz.U. of 1964, No. 16, item 93 as amended), Corporate Diplomats & Translators shall assume limited liability, solely to the amount of the price paid and costs of Service delivery. The liability of Corporate Diplomats & Translators towards these Customers shall be limited to typical damages foreseeable at the time of entering into the contract, with the proviso that Corporate Diplomats & Translators shall not be liable for possible lost profits. 
  9. By entering into the contract with Corporate Diplomats & Translators for the provision of translation services, the Client represents that they have the right to use the materials to be translated and, in particular, that they have the right to commission the material processing (translation) as a person who holds the proprietary copyrights to the translated materials, as a licensee, or on any other basis. 
  10. The Client represents that the performance of the translation by Corporate Diplomats & Translators in accordance with the contract for the provision of translation services shall not violate any proprietary copyrights, moral rights, sui generis rights to databases, patent for an invention, rights to the registration of utility models and industrial designs, rights to trademarks and any other rights of third parties. 

3. Payment Methods 

  1. 1) Payment for the performance of the Service shall be made in one of the following ways: 
    1. Payment by bank transfer, prior to performance of the Service, to the bank account of Corporate Diplomats & Translators (prepayment); 
    2. Payment by bank transfer, after performance of the Service, to the bank account of Corporate Diplomats & Translators, within 7 days of Corporate Diplomats & Translators issuing a VAT invoice for the Service; 
    3. Payment via the payment gateway available at www.globalcdt.com. 
  2. By accepting these Terms of Use, the Client gives its consent to issuing and sending electronic invoices by Corporate Diplomats & Translators in accordance with the provisions of the Value Added Tax Act of 11 March 2004 (consolidated text, Dz.U. of 2004 No. 54, item 535, as amended), it being understood that if the Client agrees to receive electronic invoices, it shall cease to receive paper invoices; however, the Client’s consent shall not preclude Corporate Diplomats & Translators from issuing and sending paper invoices.
  3. Corporate Diplomats & Translators shall issue and send electronic invoices guaranteeing the authenticity of their origin and the integrity of their content.
  4. Each electronic invoice shall be delivered to the Client via the service.globalcdt.com platform or via e-mail to the address specified by the Client in the Registration Form or in the enquiry submitted via e-mail. Any changes to the Client’s e-mail address shall be communicated to Corporate Diplomats & Translators in writing or by e-mail. Should the Client fail to inform Corporate Diplomats & Translators about a change to its e-mail address, all correspondence sent to the current e-mail address shall be deemed duly served. 
  5. The Client shall, at any time, have the right to withdraw its consent to the issuance and sending of electronic invoices by sending a written statement of intent to the following address: Corporate Diplomats & Translators Sp. z o.o. with its registered office at ul. Ksawerów 3, 02-656 Warszawa, or by e-mail to office@globalcdt.com. Should the Client withdraw its consent, Corporate Diplomats & Translators shall cease to issue and send electronic invoices to the Client, starting from the day following the day the relevant statement is served on the Client.

V. RIGHT OF WITHDRAWAL 

  1. This section of the Terms of Use and the provisions contained herein shall apply only to Clients with the status of a consumer within the meaning of Article 221 of the Polish Civil Code of 23 April 1964 (consolidated text, Dz.U. of 1964, No. 16, item, 93 as amended), hereinafter referred to as the Consumer, placing an order for the Service by way of a contract entered into at a distance or outside of Corporate Diplomats & Translators within the meaning of Article 2(1) and (2) of the Act of 30 May 2014 on Consumer Rights (Dz.U. of 2014, item 827, as amended). 
  2. The Consumer who has entered into a distance contract or a contract outside of Corporate Diplomats & Translators may withdraw from such a contract in writing without giving reasons within 14 (fourteen) days, subject to the item 9 below. The period for withdrawal from the contract shall start as at the date of entering into the contract.
  3. To meet the deadline, it shall be sufficient to send the statement of withdrawal before it expires: 
    1. to the following address: Corporate Diplomats and Translators Sp. z o.o. with the registered office at ul. Ksawerów 3, 02-656 Warszawa, or 
    2. by e-mail to office@globalcdt.com
  4. The Consumer shall have the right to withdraw from the contract by submitting a statement of withdrawal to Corporate Diplomats & Translators. The statement of withdrawal may be made on a form whose template constitutes Appendix to these Terms of Use, but this is not obligatory. 
  5. Should the Consumer withdraw from the contract, the contract shall be deemed not to have been entered into. If the Consumer has submitted a statement of withdrawal before Corporate Diplomats & Translators has accepted its offer, the offer shall cease to be binding.
  6. Corporate Diplomats & Translators shall confirm to the Consumer that the withdrawal made by e-mail has been accepted.
  7. Corporate Diplomats & Translators shall immediately, not later than within 14 days of the receipt of the Consumer’s statement of withdrawal, reimburse the Consumer all the payments made by the Consumer. Corporate Diplomats & Translators shall refund the payment using the same payment method as was used by the Consumer unless the Consumer has expressly agreed to a different method of refund that does not cause any costs for the Consumer. 
  8. The costs of the direct return of any materials received from the Consumer in connection with its withdrawal from the contract without giving reasons within 14 days from the order date shall be covered by the Consumer in accordance with Article 34(2) of the Act of 30 May 2014 on Consumer Rights (Dz.U. of 2014, item 827, as amended). 
  9. The Consumer shall not have the right to withdraw from the contract for the provision of translation services if the entrepreneur has fully performed the service – in accordance with Article 38(1) of the Act of 30 May 2014 on Consumer Rights (Dz.U. of 2014, item 827, as amended). The Consumer shall not have the right to withdraw from a contract outside of the premises or at a distance in relation to contracts for the provision of services, after the service has been fully performed with the prior express consent of the Consumer who has been notified before the performance of the service that it will lose its right to withdraw from the contract once the service has been performed.

VI. COMPLAINTS 

  1. Corporate Diplomats & Translators shall handle complaints in accordance with the provisions of the Polish Civil Code of 23 April 1964 (consolidated text, Dz.U. of 1964, No. 16, item 93, as amended). 
  2. The Client may submit complaints related to the Service contract in writing: 
    1. to the following address: Corporate Diplomats and Translators Sp. z o.o. with the registered office at ul. Ksawerów 3, 02-656 Warszawa, or 
    2. by e-mail to office@globalcdt.com.
  3. In the description of a complaint, the Client shall indicate the defect and/or (as applicable) attach any documents and other evidence giving legitimacy to the complaint, type and date of occurrence of the irregularity. The Customer may also indicate the expected manner of handling the complaint. 
  4. The use of the description referred to in the item above shall be deemed to be a recommendation only and the lack thereof shall not affect the complaint handling. 
  5. Once the complaint is handled, Corporate Diplomats & Translators shall, no later than within 14 (fourteen) days from the date the complaint is made, send to the Customer, in writing, by e-mail or by post, the information on the way the complaint has been handled. Corporate Diplomats & Translators reserves the right to send back the enquiry to the person who has made the complaint, asking for clarification of the relevant circumstances regarding the complaint. The complaint handling time may be extended accordingly, considering the time of waiting for the response of the User. 
  6. Corporate Diplomats & Translators hereby notifies the Consumer that it shall have the right to use out-of-court procedures for handling complaints and pursuing claims. The rules of access to these procedures can be found at:

  8. Corporate Diplomats & Translators hereby notifies the Consumer that it shall have the right to use out-of-court procedures for handling complaints and pursuing claims. In order to exercise its right to resolve amicably the disputes concerning online purchases, the Consumer may, for example, submit its complaint via the EU online ODR platform available at: http://ec.europa.eu/consumers/odr/. 
  9. Users that are consumers may attempt to resolve any disputes with Corporate Diplomats & Translators out of court before the Permanent Consumer Arbitration Court at the Regional Inspector of the Trade Inspection in Warszawa (http://spsk.wiih.org.pl/index.php). 
  10. In its dispute with Corporate Diplomats & Translators, the User may obtain free assistance from a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection, e.g. Federation of Consumers, or Association of Polish Consumers.

VII. CHANGES TO THE TERMS OF USE 

  1. These Terms of Use shall come into force on 1 January 2021.
  2. Corporate Diplomats & Translators may amend these Terms of Use for valid reasons, i.e. at least in one of the following cases:
    1. Any change in the law governing the provision of services by electronic means on the service.globalcdt.com platform or any change in the interpretation of the this law as a result of court rulings, decisions, instructions or recommendations of competent offices or authorities; 
    2. Any change in the way the services are provided by electronic means on the service.globalcdt.com platform, caused exclusively by technical or technological reasons; 
    3. Any change of the scope or provision of the service on the service.globalcdt.com platform, applicable to the provisions of these Terms of Use, i.e. introducing new features or cancelling the existing ones on the service.globalcdt.com platform.
  3. The changes to the Terms of Use shall be effective upon posting the new content of the Terms of Use on www.globalcdt.com, clearly specifying the date when the new Terms of Use come into force. The changes to the Terms of Use shall come into force within a period of not less than 7 days from the moment the changed Terms are made available at www.globalcdt.com, it being understood that the orders placed before such changes come into force shall be completed under the previous Terms of Use. 
  4. The User shall be informed of any changes to the Terms of Use upon the first login following the entry of the changed Terms of Use into force. The User may accept the changes to the Terms of Use by confirming/clicking the message appearing on the www.globalcdt.com login page. The User’s refusal to accept the changes to the Terms of Use shall be understood as removal of its account from the service.globalcdt.com platform. The User shall have the right to have the orders placed before the change to the Terms of Use completed under the Terms of Use in force on the date of their placement. No changes to the Terms of Use shall infringe the acquired rights of persons using the service.globalcdt.com platform. 
  5. For users who have not previously accepted the Terms of Use, the changed Terms of Use shall be effective as of the date they are posted on www.globalcdt.com

VIII. INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA 

  1. Corporate Diplomats & Translators Sp. z o.o. with its registered office at ul. Ksawerów 3, 02-656 Warszawa, entered by the District Court for the Capital City of Warszawa, 13th Business Division of the National Court Register under No. 0000863770, NIP [VAT] No. 1182214829, REGON [National Official Business Register] No. 387299795, e-mail address: office@globalcdt.com, shall be the Data Controller. 
  2. Contact with the Data Controller shall be possible by e-mail to office@globalcdt.com or by letter to Corporate Diplomats & Translators Sp. z o.o. with its registered office at ul. Ksawerów 3, 02-656 Warszawa. 
  3. Corporate Diplomats & Translators shall process personal data for the following purposes: 
    1. on the basis of Article 6(1)(b) of the General Data Protection Regulation of 27 April 2016, in connection with entering into and performance of a service contract to which the User is a party and in order to take steps at the request of the User prior to entering into a contract; 
    2. on the basis of Article 6(1)(c) of the General Data Protection Regulation of 27 April 2016, for compliance with legal obligations imposed on Corporate Diplomats & Translators in connection with entering into and performance of a service contract, including for tax purposes; 
    3. on the basis of Article 6(1)(f) of the General Data Protection Regulation of 27 April 2016, where the processing is necessary for the purposes of the legitimate interests pursued by the controller, including the need to protect the controller’s rights in court and administrative proceedings; 
    4. on the basis of Article 6(1)(a) of the General Data Protection Regulation of 27 April 2016, where the User has given its consent to the processing, and in particular for marketing purposes.
  4. The following entities may be recipients of personal data: 
    1. entities authorised to receive User’s personal data, in particular when the authorisation results from the law (including Tax Offices, enforcement authorities, and authorities conducting court and criminal proceedings); 
    2. entities processing data under the authority and on behalf of Corporate Diplomats & Translators, in particular: 
      1. companies hosting mailboxes and providing storage space to the controller (Google LLC); 
      2. external accounting office (personnel and payroll services); 
      3. legal services; 
      4. subcontractors providing translation services to Corporate Diplomats & Translators; 
      5. entities that are involved in the processes necessary for the performance of contracts to which the User is a party, including banks, credit card companies, and intermediaries for electronic payments and online payments. 
  5. The User’s personal data may be stored for a period necessary to fulfil the purposes of the legitimate interests pursued by the controller, in particular the need to protect the controller’s rights in court and administrative proceedings; however, no longer than until the claims expire. Pursuant to Article 118 of the Polish Civil Code, the general limitation period for civil claims shall be 6 years. Personal data stored on the basis of consent shall be processed no longer than until the User withdraws its consent. 
  6. Corporate Diplomats & Translators hereby guarantees the exercise of the User’s rights under GDPR, including in particular:
    1. right of access to personal data; 
    2. right to obtain the rectification of inaccurate personal data and the right to have incomplete personal data completed; 
    3. right to obtain the erasure of personal data (“right to be forgotten”) where:
      1. the personal data are no longer necessary for the purposes for which they were collected or otherwise processed; 
      2. the data subject withdraws consent on which the processing is based and where there is no other legal ground for the processing; 
      3. the data subject objects to the processing; 
      4. the personal data have been unlawfully processed; 
      5. the personal data have to be erased for compliance with a legal obligation provided for by law; 
      6. the personal data have been collected in connection with the offer of information society services; 
    4. right to obtain the restriction of the processing of personal data where: 
      1. the accuracy of the personal data is contested by the data subject; 
      2. the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; 
      3. the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims; 
      4. the data subject has objected to the processing pending the verification whether the legitimate grounds of the controller override those of the data subject; 
    5. right to the portability of personal data where: 
      1. the processing is based on consent or on a contract; and 
      2. the processing is carried out by automated means; 
    6. right to object to the processing of personal data on grounds relating to the User’s particular situation and where the processing is necessary for the purposes of the legitimate interests of the controller. 
  7. To the extent that consent has been given for the processing of personal data, the User shall have the right to withdraw its consent at any time. The withdrawal of consent shall not affect the lawfulness of the processing based on consent before its withdrawal. 
  8. The User’s personal data may be transferred to entities in countries outside the European Economic Area – Google LLC based in the United States of America. Google LLC is certified by EU-US Privacy Shield. The data shall be transferred on the basis of standard contractual clauses established by the European Commission and the highest personal data protection standards available on the market. 
  9. The User shall have the right to lodge any complaints regarding the processing of personal data with the President of the Personal Data Protection Office. 
  10. The provision of personal data is necessary for entering into a contract. Failure to provide personal data shall preclude entering into and performance of a contract. 
  11. The provision of data based on consent for marketing purposes shall be entirely voluntary.
  12. Corporate Diplomats & Translators shall not use the User’s personal data for profiling or any other form of automated decision-making.

IX. COOKIE POLICY

  2. Cookies are IT data, in particular text files, stored in the www.globalcdt.com User’s device and intended for use on www.globalcdt.com. Typically, cookies contain a website name, information about the time they are stored on the User’s device and a unique User ID.

X. FINAL PROVISIONS 

  1. Nothing in these Terms of Use shall be intended to infringe the User’s rights. Furthermore, nothing in these Terms of Use shall be so construed. In the event that any part of these Terms of Use is inconsistent with the applicable law, Corporate Diplomats & Translators agrees to fully comply with and enforce the applicable law in place of the contested provision. 
  2. If any provision of these Terms of Use is held to be invalid in whole or in part, or unenforceable, other provisions shall remain in full force and effect. With respect to the provisions that are invalid or unenforceable, generally applicable laws shall apply. 
  3. The governing law applicable to the contractual relationships shall be the law of Poland. Disputes arising from the contract shall be subject to the jurisdiction of the Polish common courts. 
  4. The platform and its components, including image files, multimedia files, text files, and source code, shall be subject to exclusive rights of Corporate Diplomats & Translators. Any copying, reproduction or otherwise use of the components of the service.globalcdt.com platform in a manner inconsistent with its intended purpose shall be prohibited without consent of Corporate Diplomats & Translators. 
  5. Users who use the service.globalcdt.com platform shall not be allowed to use software that does, or may, compromise Corporate Diplomats & Translators or Users, or violates their rights. In particular, the use of worms, spyware, viruses, etc. shall be prohibited. 
  6. The ordinary laws in force shall apply to all matters not governed by these Terms of Use.
